Legal 500 2007

The CDG advises on the whole range of business, public and commercial disputes. These include large scale contractual disputes and disputes arising out of corporate and commercial agreements, disputes over the interpretation of public law, disputes arising out of procurement by public bodies, cross border disputes, human rights issues, agency and distributor matters, transport and distributor related matters, pension disputes, trust and contested probate disputes, professional negligence claims, IT and E-Commerce disputes, and defamation actions amongst many others.

The Group is also very experienced in handling a wide variety of judicial review cases and in particular we have recently been involved in the successful defence of judicial review proceedings taken against a police body, as well as mounting a judicial review claim against central government on behalf of an NHS Trust.

We have also recently acted for a local authority client in major arbitration proceedings (leading to appeals in the High Court) between two authorities in relation to a multi-million pound dispute over money and assets following local government re-organisation. We have also acted for a number of NHS Trusts in procurement disputes and issues arising out of a tender process.

We are particularly used to working with public sector bodies, including local authorities, NHS Trusts, government departments, education and skills providers and police authorities. We have developed close relationships with such clients as a result of handling substantial pieces of litigation on their behalf, and believe we have demonstrated a real team approach here, which has involved using the clients’ own in-house expertise and, obtaining appropriate input from Counsel (we have strong contacts with barristers’ chambers specialising in acting for public sector clients).

Both in our commercial and public law practices, we are keen to explore alternative ways of resolving all disputes, and are very experienced in conducting mediation. We have achieved numerous favourable outcomes to cases as a result of hard litigating, coupled with commercial negotiating. Our philosophy is to seek to provide the client with the result they want to achieve in the most commercial and cost-effective way. We want to help clients avoid disputes arising in the first place, but if that does not prove possible, we look to provide a commercial solution to the problem. Litigation is important but it is just one of the many options available.

The CDG has developed its own website, "Indisputable".
